Terms of Service

1. Acceptance of Terms

By accessing and using the Harbor Fog Retreat website and booking our retreat services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We may modify these terms at any time, and your continued use constitutes acceptance of the updated terms. Users under eighteen must have parental consent to book and use our services.

2. Retreat Services & Scope

Harbor Fog Retreat provides curated travel planning and coordination services for wellness retreats in coastal Japan. Our services include destination research, property selection and verification, itinerary planning, booking coordination, pre-travel guidance, and post-travel support. We do not operate the properties, restaurants, or wellness facilities; we coordinate with independent partners. We are not responsible for the performance, conduct, or condition of third-party services, properties, or their staff.

3. Booking & Reservations

To book a retreat, you must complete our booking form with accurate personal and payment information. Your booking is provisional until confirmed in writing by Harbor Fog Retreat. You are responsible for ensuring all information is accurate and complete. Bookings are non-transferable without written consent and may incur additional fees. You must provide identification at check-in matching the name on your booking. If your actual identity does not match your booking, accommodations may be denied and payment forfeited.

4. Pricing & Payment

All prices are quoted in Japanese Yen unless otherwise stated. Retreat costs include curated itinerary planning, property coordination, and 24-hour support, but exclude meals, activities, personal expenses, tips, and optional add-ons. A deposit of thirty percent is required at booking; the balance is due thirty days before arrival. Payment is non-refundable after the deadline unless cancellation coverage is purchased. We accept major credit cards and bank transfers. Payment processing fees, if applicable, are your responsibility. Currency exchange rates are locked at booking time.

5. Cancellation & Refunds

Cancellation requests must be submitted in writing. Cancellation policy: (1) More than sixty days before arrival: full refund minus 5% administrative fee; (2) 30–60 days before arrival: fifty percent refund; (3) 14–29 days before arrival: twenty-five percent refund; (4) Less than fourteen days before arrival: no refund. Optional cancellation insurance is available at booking for an additional fee, covering unforeseen circumstances. Refunds are processed within fourteen business days of cancellation. If Harbor Fog Retreat cancels a retreat due to circumstances beyond our control (natural disaster, war), we will offer rebooking or full refund.

6. Liability & Disclaimers

Harbor Fog Retreat acts as a coordinator and consultant. We do not control the properties, transportation providers, wellness practitioners, or activities you will use. We make no warranties about their safety, quality, or suitability. Participants assume all risks associated with travel, including health risks from climate, altitude, water conditions, food, and activities. You are responsible for obtaining travel insurance, appropriate vaccinations, and medical clearance. Harbor Fog Retreat is not liable for injury, illness, loss, or damage arising from your participation in any retreat activity or use of third-party services.

7. User Conduct & Responsibilities

You agree to respect all properties, staff, fellow guests, and local communities. Disruptive behavior, harassment, intoxication, or violation of property rules may result in removal without refund. You are responsible for your own belongings; Harbor Fog Retreat is not liable for loss, theft, or damage. You must follow all local laws, respect cultural norms, and comply with property guidelines. Smoking, illegal substances, and weapons are prohibited unless explicitly permitted. Violations may result in immediate removal, forfeiture of payment, and legal action.

8. Intellectual Property

All content on the Harbor Fog Retreat website, including text, images, logos, photography, and itinerary designs, is our proprietary intellectual property or licensed from third parties. You may not reproduce, distribute, modify, or use this content without written permission. You retain ownership of any content you submit to us (feedback, reviews, photos), but grant us a non-exclusive, royalty-free license to use it for promotional purposes. Do not infringe on copyrights, trademarks, or other intellectual property rights.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBORFOGRETREAT SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID FOR THE RETREAT. Some jurisdictions do not allow limitations of liability, so this provision may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Harbor Fog Retreat, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, violation of these terms, infringement of third-party rights, or injury or damage you cause to property or persons. This includes claims by fellow guests or third-party service providers.

11. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the laws of Japan and the exclusive jurisdiction of courts in Tokyo. Both parties agree to attempt mediation before pursuing litigation. Harbor Fog Retreat reserves the right to resolve disputes through binding arbitration at our discretion. The losing party may be responsible for reasonable attorney fees and court costs.

12. Changes to Terms

Harbor Fog Retreat may update these Terms of Service at any time by posting the revised version on our website and updating the "Last Updated" date. Your continued use of our services constitutes acceptance of updated terms. Material changes will be communicated via email to users with active bookings. We encourage you to review these terms regularly to stay informed of any updates.
